2. End User License Agreement (EULA)
This End User License Agreement (“Agreement”) governs your use of the Whacky Pilot mobile game (“Game”), operated by Skyology Technologies LLC. By downloading, installing, or using the Game, you agree to be bound by this Agreement.
3. License Grant
Skyology Technologies LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Whacky Pilot for personal, non-commercial entertainment purposes.
4. Restrictions
You may not:
- Copy, modify, redistribute, exploit, or create derivative works of the Game (except as permitted by law).
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Game.
- Interfere with the normal operation of the Game or attempt to bypass security or access controls.
5. Ownership
The Game and all related intellectual property rights are owned by Skyology Technologies LLC. This Agreement does not grant you any ownership rights.
6. Digital Content (In-App Purchases)
All in-app purchases, including level unlocks and ad-free versions, are licensed—not sold—and are non-consumable. Availability of purchased content may change due to technical or legal requirements.
7. No Warranty
The Game is provided “as is” and “as available,” without warranties of any kind, including warranties of performance, availability, or error-free operation.
8. Limitation of Liability
To the maximum extent permitted by law, Skyology Technologies LLC shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Game, including bugs, crashes, or loss of progress.
9. Termination
This license may be terminated at any time if you violate this Agreement or other applicable terms. Upon termination, you must stop using the Game.
10. Apple Disclaimer
Apple Inc. is not a party to this Agreement and is not responsible for the Game or its maintenance or support.
11. Arbitration & Class Action Waiver
Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration in the State of New Jersey. You waive any right to participate in a class action.
Terms of Service & Privacy Terms
12. Privacy Summary
Information We Collect: Whacky Pilot collects minimal, non-personal data including anonymized device information, gameplay progress, and in-app purchase records.
Information We Do Not Collect: We do not collect names, email addresses, phone numbers, location data, voice input, or chat content.
Advertising & Analytics: The game displays banner advertisements using Google AdMob and uses analytics and crash reporting tools to improve performance. Whacky Pilot does not engage in cross-app tracking.
Children’s Privacy: Whacky Pilot is intended for players ages 9 and older. The game is not directed to children under 13 and does not knowingly collect personal information from children.
Data Storage: All data is stored securely using Firebase.
Data Sharing: We do not sell user data.
13. Acceptable Use
Players may not:
- Cheat, hack, exploit bugs, or interfere with normal gameplay.
- Modify the game, bypass restrictions, or attempt to gain unauthorized access.
- Use the Game in a manner that is unlawful or that violates this Agreement.
14. In-App Purchases & Advertisements
In-App Purchases: All in-app purchases are non-consumable digital goods, including individual level unlocks, level packs, and a one-time all-levels ad-free unlock. All refunds are handled exclusively by Apple or Google.
Advertisements: The game may display banner advertisements unless an ad-free version is purchased.
15. Progress Reset
Skyology Technologies LLC reserves the right to reset player progress in cases of abuse, cheating, or technical issues.
16. Governing Law
This Agreement is governed by the laws of the State of New Jersey.
